Frequently Asked Questions

Title insurance protects against losses from title defects, fraud, survey issues, and other title-related problems not discovered during the title search. While not legally required, it’s highly recommended for additional protection. 

A subject condition (or “subject clause”) makes the contract conditional on specific events such as financing approval, property inspection, or document review. Conditions must be removed or waived by specified deadlines, or the contract becomes null and void. 

Freehold (or fee simple) means you own the land and any buildings on it. Strata means you own a unit within a development and share ownership of common property with other strata owners. Strata properties are governed by the Strata Property Act and strata bylaws. 

Typical residential transactions complete in 30-90 days from acceptance of the offer, depending on the completion date specified in the contract. Commercial transactions often take longer due to more complex due diligence. 

Closing costs include legal fees, disbursements (title searches, registration fees, etc.), property transfer tax (for purchases), title insurance, and other transaction-related expenses. We provide detailed estimates early in the process. 

In BC, property transfer tax is payable on most property purchases, calculated as a percentage of the purchase price. First-time homebuyers may qualify for exemptions or reductions. Foreign buyers face additional tax. 

We identify and explain any title issues (liens, encumbrances, easements, etc.) and work to resolve them before closing. Some issues may be acceptable; others may require negotiation with the seller or, in rare cases, termination of the transaction.
