Uncontested divorces typically take 4-6 months from filing to final order. Contested divorces involving property division, support, or parenting disputes can take 1-2 years or longer, depending on complexity. 

No, but it’s highly advisable. A separation agreement resolves property, support, and parenting issues, making the divorce process smoother and less costly. 

Under BC’s Family Law Act, family property acquired during the relationship is generally divided equally. Excluded property (owned before the relationship, gifts, inheritances) typically remains with the original owner, though exceptions exist. 

Child support is calculated using the Federal Child Support Guidelines based on the paying parent’s income and number of children. Additional expenses (Section 7 expenses) for childcare, healthcare, and extracurricular activities may also be shared. 

Support orders can be enforced through the Family Maintenance Enforcement Program (FMEP), which can garnish wages, intercept tax refunds, suspend licenses, and take other enforcement actions.

Probate (applying for a grant of probate) is the court process confirming your will’s validity and the executor’s authority. It’s typically required for estates with significant assets, real estate, or financial institutions requiring court confirmation.
